Indefinite leave more than 90 day stay case

Hi

I came to UK in 2006 March on work permit and still on work permit. I have completed 5 years. I need to know whether i can apply for indefinite leave to remain or not.

In 2009, i was out of country for continuous 8 months. I was still the employee of same company but worked at offshore due to some personal reasons.

Can some one tell me if i can really apply for Indefinite leave to remain or not? Will more than 90 days stay can cause any problem for my application.

You need to get a support letter from your employer explaining why you were working offshore. Also if the salary during that period is paid here in the UK and you paid the tax and NI contribution here then you have good chance to get ILR.

yes it could cause big problems. any single absences over 90 days usually re-set ILR clock and it is down to caseworker's descretion. you will need very strong justification of absence (unless an emergency personal reasons like birth of a child may not be considered strong enough).......

you should consult a solicitor.
