New SET(O) form qualification Points Query (Page 19)

Hello All experts,

My details are as follows:
Date of first arrival – 04/Sep/2006 on WP

HSMP Granted on – 03/April/2007(for 2 Years)

Extension under Tier 1 General (as HSMP route closed ) approval letter – 31/Mar/2009 given until 03/Apr/2012(3 years)

I am confused after looking at new form (SET O) released today which states as on Page 19

“B3. Please indicate the points being claimed for your qualification, including equivalent professional/vocational qualifications:
Applications for indefinite leave to remain where you have had leave as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010.
* you can only claim points for a Bachelor’s degree level qualification if you have previously been granted leave to enter or remain as a Tier 1 (General) Migrant, Writer, Composer or Artist or a Self-Employed Lawyer; and that leave was granted before 31 March 2009.â€

Hi,

I would like to stress on the fact that I was awarded 30 points in my last application(Leave to remain under Tier 1 General) and I have read in one of the migration documents that I can claim same points as I was awarded in my last successful application.I am full time confused here that I can claim points on my bachelor's degree or not?

Please clarify?

Keeping your following details;

in mind the first Question is that what category you will apply under? Tier 1 General or HSMP?

If you look in SECTION 3 of the form you got Tier 1 General in A and Highly Skilled in B.

If you select Highly Skilled Migrant option then you don't need to think about SECTION 9.

But Question is what category you fall in for ILR?

Hi qfmomen,
Thanks for your reply. As per my understanding I should apply under my 'current' category which is 'Tier 1 General'.
Please correct me if I'm wrong.

I had the same understanding but many people are saying that people like you need to select HSMP. The reason behind this is that HSMP was closed and All HSMP people got extension as Tier 1 General. But i am not sure and have to wait until someone from Home office give us some information. I called home office and the guy said that you can select any which seems to me little bit surprising because they need to hold on this new changes and it will take some time.
