Bachelor degree points when first application is under HSMP

Hi All,
Sorry to ask this question again on this forum as the new rules are in place now. I am bit concerned for points of Bachelor degree. On page 18 on the new form it says

“you can only claim points for a Bachelor’s degree level qualification if you have previously been granted leave to enter or remain as a Tier 1 (General) Migrant, Writer, Composer or Artist or a Self-Employed Lawyer; and that leave was granted before 31 March 2009.â€
