WP senior carer ILR refuse

Hi moderators,

I hope you can enlighten one of my friend who got their ILR application denied yesterday (premium services in shefield) because his salary is not £7.02/hr. He is in 5 yr WP, senior carer, work at the same company for 5years, no visa gap, his application maybe straight forward if he applied before april 6, but his whole family application got refuse (good bye £4,050) because he didnt met the wage for senior carer that is £7.02. my question is
1. Can he still apply for extension under transitional arrangement D ?(his company offered them extension but he op out thinking that they will not be affected by this new changes)
2. Can they make an appeal regarding this matter evendo the case worker said they have 5% chance of appeal. (case worker got their original documents and told them that they have to wait for 1 week before their papers can be returned)
3. or make fresh application under tier 2 general
I hope you can give an advice regarding this matter. There visa runs out on 16/5/2011.

1. No.
2. One can appeal only if given the right to. If your friend's WP leave hasn't expired, then he wouldn't have been granted the right to appeal.

What's your plan Gerard820? Are you going to re-apply or since you were denied thechance o appeal, going for a court review?

If you are planning for the second I think there would many other people in the same situation and it's worth considering a mass action by collecting all these people.
