long-winded question about ILR and marriage visa

this is maybe not going to sound good, but bear with me, i have my reasons.
i married a Indian lady roughly 3 years ago. the marriage is not really going well and we are probably going to either separate or end things amicably with a quickie divorce soon. she hasn't yet received her ILR yet, but i would like her to get it before we split up since i do get on ok with her. What's the best way to go about her getting ILR, i don't want to make her life here harder than it is?
before my marriage to the 1st lady i had been in touch with a different woman in India who i now want to marry. To apply for a spouse visa I guess I am going to need documentational proof that my marriage is in the process of ending, and I would ideally like to start this process now as it takes a long time. What would constitute proof?
