Help!10 years long residence: regarding the criminal record

Dear all, my husband is about to apply for the 10 years ILR, his visa has no gaps. However, he just found that he has an traffice offence during June 2008, when his father came to visit him in the UK. His father tried to test his car on the road in front of their flat, and then caught by the police. Both of them received a letter from the court. His father was fined 500 pounds, and he was fined 100 pounds and 6 points. I just wonder under the new regulation, whether this will affect the ILR application? If it does, which means, he needs to wait until five years later after the convition of the offence?
