how much chance can I get ILR?

dear friends,
can anyone help me with my case,
I want to apply ILR under 10 years rules, however there was a gap between my visas causes me worries--- before my visa was due to 31 August 2009, I made application in August and it was rejected because of the photo was too old, then I made a fresh application on 14 September 2009, and renewed visa on 5 October. I have checked SAR, it shows two raised dates which were 11 August 2009 and 14 Sep-2009, considering the date between 2 visas, there are 35 days gap (between 31 Aug and 5 Oct). SOOOO, my worry is for a gap like this, any chance to get ILR, any similar case like this happened before? any help will be great appreciated, thanks. xwjohn
