ILR Eligibility Query

I have some doubt about on my eligibility for ilr application. Visa stamped -24/08/2006. Visa expiry date - 24/08/2011. First UK entry date - 06/10/2006 delayed by 42 days. So I am bit confused about my ILR application submit date. Do I need to extend my visa before expiry date (24/08/2011) or can I apply for ILR 28 days before my visa expiry date? Please give me a urgent advice on this matter...

simple my friend, ur clock starts from 06/10/2006, means ur 5 yrs will end on 05/10/2011 and it also means that u can apply only 28 days before 05/10/2011...hope this clears to u now..

Not really....!
My case was - WP stamped out of the UK on 20th Jun 2006
Entered in UK for first time - 06 Aug 2011 (so 47 days delayed)
visa expiry date - 20th Jun 2011

From your calculations i was eligible to apply on or after - 09 Jul.
I applied on 26th May calculating my period from Visa stamped date which is based on guidance and my application was successful.

As per guidance - if leave is expiring before the 5 yrs from data of entry you can still apply provided the period between visa granted and data of entry is not more than 90 days.

Joyjohn - Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but will not have spent fiveyears continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.
You can apply 28 days before the expiry, provided the gap is not more than three months. Give the link below a good read.
