a couple of questions regarding ILR documents please reply

Hi there,
I am due to complete my 5 years under HSMP(initially granted october 2006 visa stamped within uk on 14th nov 2006: changed from post graduate doctor visa). I am trying to get organised and getting the documents ready for the application and was unsure about a couple of things

1)I fall under april-nov group of hsmp JR so I am hoping it would be straight forward but regarding cohabition documents do I need to show proof for the last 3 years(i mean since last extension) or the whole 5 yrs. Since coming to uk in 2005 me and my wife has always had the same type(plab-pft-hsmp/dependent) visa and same entry exit seals on the passports.

2)If I am planning to apply around 16th/17th october when should I start looking for peo appointments(I intend to apply at either croydon or solihul and I live at belfast) and also any calculators to safely calculate the 28 day period in which i can apply?

3)My wife would be heavily pregnant with our second child at that time(first one born in the uk) and I would want to go myself to the peo with all our applications is that permissible? and if so do I need to book only appointment for myself?

4)anybody knows of a good website where I can upload pictures taken in my DSLR and order online printout of the required passport size pictures(the size accepted by home office)

5)As some of you guys would remember both me and my wife had a police caution(formal) in march 2006 which still shows up in our enhanced CRB as caution, do I need to declare that as a criminal conviction in the application form?

Hi,

For point No.4 you can try the following (I haven't tested this myself but just passing on the info) :

1) Take your photo - based on UK passport guidelines
2) Goto http://www.epassportphoto.com/
2) Choose UK and upload ur foto - then resize it (v.easy)
3) At checkout page, choose "No Thanks" and then choose "download the picture sheet" -- save as a JPG file (onto USB stick) - this will give u a picture of 7 of ur fotos
4) Goto Boots in store - use USB in Photo machine and choose 6'x4' ___ pay 20p for 24hr service.

Hi,

1. The cohibitation requires the proof for the last two years only. No need to get panic for 3 or 5 years.

2. From the date you landed in UK add 1826 days. Then Minus 28. You will come with the date from when your period of 28 days start. Book an appointment from that day onward.

3. There is no need to take your wife for the PEO appointment. I am not sure if your Biometric has already been done or not. Because, for biometric the person has to be present.

4. This has already been replied.

5. The rehibilitation of Offender Act 1974 gives the exact details as to what crimes or cautions etc are included in spent or unspent categories. In case you need exact details regarding your case, you better write detail email to NACRO. As they are the agency consulted by Home Office for advise on this.

regarding biometrics never had to do it during first approval or extension so is it manditory for ILR?

regarding rehab of offender's act I tried to contact a few people and most of them said that there was a new act in ?2009 which makes all cautions spent immidiately?? confused there. anyways really grateful for your help.

since you are covered under jr, unspent conviction clause is not applicable to you even if you have one. please relax.

You are right Khalid. The JR will help here.

However, at the stage of citizenship, this thing will again jumps in...so better for him to check right now.

There is no act that says that all the convictions is considered spent immediately. All of this type of questions should be asked to NACRO. as this is the agency who can reply with authentic answer and whos answer/verdit is acceptable by home office.

Please contact them.

thanks again guys for the advise, but I believe caution is different from conviction and it is indeed covered under the rehab of offender(unless its a caution which is conditional for extreme violence/sexcharge/drunk driving/driving without insurance or foreign licence)
