MEWP - ILR qualification

Guys,

Im planning to apply ILR and wanted to know my eligibility. My current VISA and past VISA types are listed below. Please advise.

August 2006 - July 2007 - Workpermit visa with Multiple Entry
July 2007 - December 2007 - Residence Work Permit
December 2007 - December 2009 - HSMP
January 14 2010 - January 13 2013 - Tier 1.

Neither I have been outside UK more than 90 days at a time nor spent more than 180 days outisde UK in 5 year period.

In or after August 2006, when did you first actually arrive in the UK? Exact date please.

28 days before the 5th anniversary of that date is 5th July 2011, so I think you can apply on or after that date.

John , thank you very much for your quick reply. One of my friend said that Work permit with Multiple Entry doesnt count towards PR period of stay. Can you double confirm ?

that is not true. all work permit visas are multiple entry visas.

i am unsure regarding your second leave, residence work permit? what do u mean? i dont think there is a visa category called residence work permit. Is your visa just a normal work permit or did you mean something else like permit free training visa given to doctors etc.

Just phoned UKBA and they confirmed that Work permit Multi Permit doesnt count against the stay. IM confused. Please advice.

OP- whats the difference between residence permit and work permit. Does your residence permit give full right to work?

Give your full histroy. Did you get your first work permit from out of UK? Who extended / applied for second "residence permit"? Do you have home office letters that were given when these applications were made. If so what do those letters state regarding type of visa that is granted?

The link states that Multiple Entry Work permits can not be extended within UK and one has to leave UK (and hence there is a break in residency and hence allegedely one can not qualify for ILR). Did you leave UK.

As i said eariler, give more information.

My first visa is Work Permit - Multiple Entry provided by INDIAN employer and it was applied from INDIA. I will update the post with paper information later this evening. During July 2007 , I had Work permit through my new employer. This is applied from with in UK and it stated as Residence Permit.I had that VISA until December 2007 and switched to HSMP (Dec 2007 - Dec 2009). Then on Jan 2010 , I was granted Tier 1 Visa.

Multiple entry work permit employment is covered by immigration rules 199A-199C.

IMHO - If OP was in UK under this category between 2006 and 2007, then the time spent in the UK under this category (and any previous stay in any immigration category preceding period, if any) cannot be included in the "qualifying residential period" for settlement, as this category is not considered as a "qualifying work permit" category (128-135) for the purpose of settlement.

OP needs to make sure which category was he in UK under (until 2007) - those covered under 128-135 or the one covered under 199.

My case was exactly like yours :
July 2006 - Multiple entry WP
May 2007 - Residence Permit from Another employer
Feb 2008.. HSMP
Feb 2010 - Tier-1
June 2011 - i have got an ILR approval last week

So i guess you should fine.

I applied myself...didn't want to waste money on solicitors ..this forum was very helpful for me to apply myself..

Ask the employer who sponsored that WP. I guess that's the only way to find out.

Do you have copy of your WP ? It should be stated there. MEWP were like intra company transfers with multiple entires. Were you working for same company in India who applied for your work permit?

Also when you applied for extension of visa in UK which form did you use. Was it FLR (IED) ?

FLR(IED) cannot be used for MEPS.

Yes, I was working for the same company in INDIA as well as in UK initially. I got through another JOb in UK who did the next work permit for me. They didnt inform whether they applied for new WP or they transfered the exisiting WP.
