Previous Earnings: Less than 12 Payslips OK or NOT?

I have got My HSMP done in June 2007 when I was in UK on SEGS.

Extended to Tier 1 General Migrant in June 2009

As SEGS is not considered, my ILR is due in June 2012

Now according to rule,

- To show my earnings, I will have to show my 12 months payslip and 12 months statements. (That means from June 2011 to May 2012).

But unfortunately, I have been made redundant in April 2011 and still looking for job and I don’t know how long will it take.

So my questions are:

1. Is it ok if I show 10 or 11 payslips and bank statement which covers my required earning? (less than 12 payslips and statements)

2. Does it require to show same or higher earnings then what I have shown during my extension for Tier 1 General Migrant in June 2009?

(Explaining my 2nd question:

- When I extend my HSMP in June 2009, I was on £30K pay.
- Right now I don’t have any job.
- To receive 75 point for ILR, I have to show earnings from £20,000 - £22,999.
- So is it ok if I show these earnings or do I require £30,000 mark because I have shown that during extension?
- Is it ok if I show my earnings with less than 12 payslips and statements (1st question) )

As long as you meet the earning criteria does not matter if it is in 10 or 12 months. But I think you should be earning the same as you last Tier 1 extension.

Hi Kash, there are a number of cases on this forum you should read that about regarding the earning. But by and large what Rentmeda has said is correct. The earning shold be at the same level which was at the time of extension. Do search this forum for similar cases.

You need to make sure you are able to claim the minimum 75 points along with economic activity prove and the new criminality threshold! There is no requirement to be earning more than what your income was at time of extension as long as you meet the minimum points required!
