P60 issue - Full income not showing due to Childcare

Post by nishu » Thu Jul 07, 2011 3:33 pm

Hi All,

I am due for ILR early next year however came across serious problem with earnings proof.

I am on WP + Tier 1 and paying off childcare out of my salary each month which is deducted before tax. I came to know that my P60 will be only showing taxed income therefore it may give problem to my ILR eligibility as earnings criteria will not be met.

However my payslips clearly shows my basic pay and deductions seperately. Shall i cancel childcare or there won't be any issue?

I am concerned as officer may reject application on the basis of income shown on P60 itself. There is no such problem with previous P60 because childcare sceme only started after March this year.

Your help would be appreciated.

You need two pieces of evidence from two sources. IMHO you can have payslips and bank statements or may be a letter from your employer stating your gross and net yearly salary.

it should not be a problem. keep your salary slip and bank statement..

Childcare does not fall in public fund..

Thanks all for your views.

Yes, I believe letter from employer with salary is good idea.

Also, my next year P60 probably wouldn't arrive before I apply for ILR therefore pay slips + bank statement + letter from employer should do job.

I did not come across any evidence suggesting childcare as a benefit but if any one has that please let me know.

Thanks again :)

Solicitor review

Post by nishu » Thu Jul 21, 2011 2:08 pm

I sent my pay slip to solicitor and she told me that points will be calculated on the basis of gross salary - childcare deductions. Therefore she means that childcare voucher will create issue with my ILR application.

I am really shocked and now worried over this.

Seniors, please confirm if this is correct. Following is case

Gross Salary (Shown as Basic Pay on my Pay Slip)
Chilcare vochers -

Total payment = Basic Pay - Childcare vouchers

Pay after tax = Total Payment - Tax

My question is will Home Office not consider my Gross Salary but calculate points on the basis of salary after childcare deductions.

Only benefit I am getting here is saving tax on Childcare voucher therefore that should come under my earned money Isn't

Sorry for long explanations
