Dependent born in Uk

Hi I am Indian national due for ILR soon.My son was born in the UK in 2008.He is included on my dependent visa .Do I need to get him ILR or can he directly go for Citizenship since born in the UK after I get ILR ?At the time of his birth both the parent were on work permit .Kindly advise.Thanks

you can apply for your shild British Citizenship once you get your ILR.
No need to apply for ILR for your child.

I have same problem. I am applying ILR on 19-7-11. have children <6 age, all born in uk and on dependent visa untill april 2012. I e mailed UKBA and this was reply.

Please note that if your children were born in uk before you obtained ILR, you will have to apply ILR for them before they are eligible for citizenship.
The correct procedure is to apply for ILR of dependents with your application.


I am very confused. I still have appointment booked for me and children but not sure what to do.
Do i apply for ilr for kids or cancel their appointment ang apply for myself and my wife.

Any guidance please.

So I guess it is everyone,s personal decision.

On one hand you have section 1(3) and on the other hand UKBA advice.

I wonder what is moderator,s personal take on it.

as I wrote many times, front line officers are not more intellegent than any one selling fries on Mcdy.

If children were born in UK then you can apply for their Registration under 1(3) once you get ILR.

if you don;t want to save money then apply for ILR before that.

Thanks Guys,

Here we go,

Contacted Nationality checking service. Booked appointment for my kids.
The advisor there said that my children certainly DO NOT need ILR and can be registered under section 1(3) after my ILR.
