Hi,
I came to UK in october 2006 as work permit then changed to Tier 1 in 2009. I was with same employer until Nov 2010 but then I opened my own company and have been working for a US company since then.
US company sends my salary UK business account which I then pay taxes and salary to myself.
I have also travelled on business for above company.
Please could you guide me on all documents I should take with me to PEO.
Thanks a million for your help.
Regards,
Nik

Can you clarify this as it's rather confusing? Is your company providing a service to the US entity and is the revenue from this being declared to HMRC as part of your company accounts? Or are you saying that you are employed by this company?

Thanks for your interest.
Basically I am employed by that company but since they do not have offices in UK I had to open my own company and they pay my salary in my business account.
Hope it makes sense.

Nik

You are self-employed and, for the application, will need to provide evidence that relates to self-employed income. Have you actually read the guidance as it's very clear about what combinations of documents are needed and their source?

I have found this guidance notes on UKBA but it does not have any info on documents:

May be I am using wrong source? Could you please guide me where to get correct documents.
Thanks and regards,
Nik

Have you registered with HMRC as self-employed and if so have you submitted annual self-assessment tax returns? Do you have a business bank account?

Nick,
I'm sailing on the same boat as you. I am self employed, working for a us company and do business development for them here in UK.
I dont have my own company, I just work as an independent consultant for them. I invoice them every month and they pay me.
Do i need to have an business account to receive my funds every month from my us company?
Would It be a problem while I go for my ILR next year as my US company is not registered in UK?
I have already travelled more than 220 days outside UK in the last 5 years for business ( none of my absence is more than 13 days )
Please help
Thanks,
Basha

Hi Basha,
I am not sure but when I was changing job last year I did some searches and I had two options
1. You work for an umbrell company and they pay you or
2. you open your company and pay yourself.
both of them should work. If you are under an umbrella company they should give you all the documents you require for proving you work etc.
regards,
Nikesh

Hi Nikesh,
As Casa has said in some other posts, if you are a director of a limited company, you are not self-employed. I have asked this to my accountant and he has confirmed the same.
So if you are not a director, then you are self-employed and need to register with HMRC as self-employed.
Thanks

Guidance is clear. You can have your own limited company and now you are not self employed. This company should have business account, contract copies of work performed, salary and complete company accounts by qualified accountant, should have paid corporation tax etc etc..For self employed as a contractor you need registration with HMRC, pay class 2 insurance, copies of invoices stating services provided, bank statement (Not necessarily business account) your Unique Tax Reference, accounts prepared by accountant and a letter from accountant that you are self employed.
I am not sure about umbrella companies
