English language requirement

Hi All,

I have multiple questions with regarding to my ILR. Can any body help me

1) I am due for my ILR in May 2012. By that time my wife will not be completing her 2years of stay in UK. So I need to go for extension of dependants visa for her.
When she applied for dependent visa for the first time there is no English language requirement. But now when going for extension of dependent visa does she need to prove English language requirement.

2) My son also will need to go for extension of dependent visa. but by that time he will be crossing his 18 yeas of age. What proofs I need to produce that he is still dependent on me.

Are you a PBS migrant? I think you mean that she will switch into FLR(M) rather than, as you suggest, extend her current PBS dependant leave. There is no language requirement for PBS dependants but there will be for a switch into leave to remain in the partner settlement category.

Paragraph 319J suggest that your son can apply for ILR with you but will need to have to have passed the KOL if over 18. He will also need to be unmarried or not in a civil partnership, must not have formed an independent family unit, and must not be leading an independent life.
