ILR Eligibility - Very Confused - Please carify

Dear Friends,

Please could you help me in getting clarity for my below query? Many Many thanks.

Query: This is about when I should apply for my ILR.

(1) Initial HSMP Visa - Stampted on passport on August 31 2007 in INDIA

(2) Entered UK on 24-October-2007

(3) Extended visa under TIER-1 General In UK visa Valid until August 31 2012.

As you have observed above, from (2) and (1), I have entered UK 54 days lately after getting my initial HSMP VISA.

When should I make an application for ILR or become eligible to apply for ILR or Do I have to go for Second Tier-1 General Extension?

Please advice.

No, you don't need to extend again and can apply in August before your leave expires. There is a concession that allows for up to 3 months of late entry to the UK to be aggregated into the qualifying period.

Does that mean that, on top of 3 months exemption, I could also use another perk which allows anyone to apply before 28 days of their respective visa expiry date?

Please advice.

Yes. You can use that 28 days allowance. This means that you can apply for ILR after 3 Aug 2012.

Since the 28 days grace period start from your first visa valid date. So you can apply for ILR after the date mentioned above.
