ILR Success-More than 28 days gap between EC &Entry Date

I have finally and successfully got my ILR at Croydon this week. More important to note is that I had a gap of more than 28 days (38 days to be precise) between my entry clearance date and first entry date.

Having been an ardent fan of this forum, I have benefited a lot from the forum and would like to give back on some of my experience for the benefit of the members. I will post my detailed experience tomorrow.

SET-O query

Congrates!!

Can you advise on below query?

1) In SET-O form on page 20, D1 they have ask to tick if I have completed lawfull 5 years in UK.
Buy I am short of 23 days to complete 5 years and going for ILR as can do 28 days before .
What should I select ?

It seems you are within 28 days of completing 5 years in UK, i.e., you have completed 4 years and 11 months. If that is so,you can tick "Yes" as an option for completing 5 years of stay lawfully in UK.

Congrats to coolguycp1,

Please can you advice on my case below:

Visa uk clearance expire 15th feb 2013
First entry to uk28th feb 2013.
On work permit

I called and checked with ukba and was told the earliest I could apple is 31st jan 2013.

However, I am hoping to apply earliest possible before 31st jan 2013, say 15th jan 2013. Is that possible? Any chances the caseworker will reject my application?

Reason for doing this is I need my travel doc including biometric residence card by 1st feb 2013 to travel.

Did you manage to get your application approved based on you being 23 days shrt???

What did you respond to "I have completed lawfull 5 years in UK" question?

I have 49 days gap, can I say yes to this question?
