confusion for when to make ILR application

Hello everyone.

I am a tier-1 visa holder (general) and I got refusal during my extension. so my actual case date is below

JAN 2007 : got HSMP visa
JAN 2009 : Refusal of extension under tier 1
June 2009 : got stamp of tier 1 up to June 2012

I have couple of queries about ILR application as under :
1. If I count 5 years rule from initial grant I will be eligible for ILR in Jan 2012 or not? When should I apply for ILR in Jan 2012 or June 2012?
2. I was on maternity leave since Feb 2011 to June 2011, If I apply for ILR in Jan 2012. what period of earning should Home office will count? can they count my maternity leave?

Since your appeal (against the refusal) was successful, you have been in the UK lawfully since Jan 2007.

So, Jan 2012.

Yes I applied for appeal and my appeal was successful.
