ILR for partner currently on Teir 1

HI All
My query is can my partner (married and staying together since Jul 2008 in UK) apply for ILR as my dependent.
I wil be completing 5 years in the UK in Nov 2011.
This includes ( Nov 2006 - April 2008 on WP )+ (April 2008 to April 2010 on HSMP) +( April 2010 till April 2013 Teir 1 (HSMP Extension)).
Wife joined in Jul 2008 on her own Teir 1 (Issues in June 2008). Extended once in June 2011 and now valid for another 2 years.
Can I add her as my spouse/ dependent when I apply for ILR in Nov 2011.
I guess the basic question is , if your partner has been married and staying with you in UK , but on her own Teir 1, is she still eligible for ILR with you.
I know this issue has been discussed a lot but mostly by Judicial Review cases. Hence would really help if some one has had a similar experience or if the Senior members have any opinions.
