Hi Guys,

This forum is so useful. I have found so many good answers on here. I was hoping you can help me out here.

I came to the UK in Sept. 2001. Student visa for 4 years. Then 1 year on SEGS (Science & Engineering Graduate Scheme). Then on work permit since Oct' 2006.

I have decided to apply for ILR (eligible from tomorrow) based on 5 years on the old work permit which I obtained on the 23rd of October, 2006. My wife joined me last year in November as work permit dependant visa. She is expecting a baby on November 20th this year.

Now a couple of questions:-

1). Can she apply with me as dependant on the SET(O) form even though she has not spent 2 years in the country?

2). If the baby is born before I get my ILR will be the baby be considered as 'British' even though potentially I might not have the ILR status till then? Can I wait till I register the baby's birth for a period of 6 weeks, hoping that I obtain my ILR till then so the baby qualifies as British citizen? Or will the baby be 'Pakistani' if at the time of birth I do not have my ILR? Is there flexibility that they consider the baby British on the basis that ILR Application is pending? If not then I can consider making my application as premium rather than postal.

Please advice.

Thanks sushdmehta. Does that mean that the date of significance will be the DOB for the baby and not the date of birth registration for the baby? For example if baby is born on the day when our application of ILR is with case worker, he will not be a British citizen and will need to register as one when ILR is granted to us?

Do not confuse "registration of birth" with "registration of a minor as a British citizen".
And, " date of birth registration" is never relevant ... for any purposes! The date of birth of a child is the date he is born, and not the day his birth is registered!

In addition

It asks for What is your pay each month after income tax and other deductions? I get paid overtime each month but that figure is varied as reflected on my payslip. Do I include the overtime in that figure?

Options:
1. Use a "average" figure.
2. Use the figure that represents the constant fixed salary (i.e.- excluding the variable overtime).

Thanks alot for ur answer. Just finally, I know this is in the FAQs, but I am not taking any photocopies with me to the appointment on Wednesday for SET(o). Can that affect my application? Thanks
