ILR requirements

Hello all,

I will be completing 5 years in UK on 23-Dec-2011. I am on Tier 1 (general) visa.

I have few doubts about submitting the application:
  • 1. When can I apply?

    2. How long before I make the application that I need to do the 'Life in UK test'? Can I do it now?

    3. I got married on 10-April-2011 and my husband came to UK on 21-July-2011. His visa status currently is Tier 1 (dependent). Can he apply for ILR along with me?

    4. If only I apply and he can not, what will be his visa status after I get my ILR?

    5. I am going to India on leave for 4 weeks soon and returing on 01-Dec-2011. Can I make the application as soon as I return?

    6. Will my holidays immediately before applying ILR affect my application?

    7. I have been out of UK for 160 days in the last five years (including my holidays next month). Is this too much?

    8. Can you please point to a link where I can find all the requirements for ILR applicaiton?

The link posted by sushdmehta has answers to all your questions apart from Q4 (I think) for which, the short answer is that after you get ILR, he will have to switch to FLR(M).

A small correction to the response above:

Your husband (PBS dependant) will need to apply for FLR(M) before any of the following occurs:
1. His current PBS dependant leave expires.
2. He travels out of UK.

There is no requirement for the FLR(M) application to be made within "28 days of you receiving ILR".

Thanks for the correction, I agree, I think I misunderstood the general rule of extending / switching 28 days before expiry - as applicable to this situation since main visa holder is no longer on the category (T1G) using which the dependant is in the country.

I have corrected the previous response so no one is misled.
