Hi

I have a Tier 1 visa until 22.12.11. I have applied for settlement under the long residence rules in September 2011 and am awaiting the return of my passport. I have a child who was born in the UK and also has leave to remain in the UK until 22.12.11 as my dependant. As he does not meet the requirements for long residence (i.e. 10years), I could not apply for settlement for him, along with myself.

Could you please tell what is the guidance for this and which form to use?
Should I wait until I have the ILR stamp on my passport ( as well as my wife's)

Regards

After you are granted settlement, your UK-born child will be entitled to be registered as British citizen under section 1(3) of BNA 1981.

Your (UK-born) child does not require any leave (limited or indefinite) to remain in the UK. It doesn't matter if the child's (dependant) leave will expire on 22-Dec.
