ILR Query - No of days outside country

Hi Everyone,

I got my Tier 1 (General) Migrant VISA which was stamped in India on 28th Aug 2008. I entered UK on 4th Oct 2008 which is 37days after VISA stamping date. Could someone advice does the 5yr clock for ILR start from the day my VISA was stamped or from the date I first entered the UK/port of entry i.e 4th Oct 2008. Also I have made 4 trips to India in a span of 3yrs till now and considering all that, it comes up to 125days i.e 37days the initial + 4 trips in 3 yrs to India which amounts to total 125days. All these holidays were annual paid leave hence would like to confirm do they count these holidays as well when calculating the 5yr rule.


Would be great help if someone could kindly advice.

Your ILR clock starts only when you entered into the country which is 4th Oct 2008. also for ur out of country days, you cannot count initial 37 days which is prior to your first arrival.
All these holidays were annual paid leave hence would like to confirm do they count these holidays as well when calculating the 5yr rule.
Yes they would count these holidays as well.
