5 Year Qualifying Period for Indefinite Leave to remain

Dear All,

This is a great forum to post Visa queries. I have been able to find very good information. I have one query.

1. I got HSMP Visa on 31 Oct 2007. I came to UK on 30 Dec 2007.
2. I had only five exits from UK till now. All were ranging from 5 days to maximum of three weeks. Hence, i would state total days of exits are less then 60 days in last 4 years in total. I may go for another 10-15 days in June 2012.
3. I had to take an extension in 2009 which was a Tier 1 extension and it expires in 31 Oct 2012.
4. My query is that since i entered UK on Dec 2007, two months after my visa started, am i eligible for indefinite in October 2012. I will complete 4 years, 10 months in October 2012 and i will fall short by 2 months. Someone told me that i would be eligible if i fell short by 3 months and my exits are not more than a total of 180 days in 5 years. However, it would be great if experts in this forum could comment on my query.

Yes you r right. Can apply for ilr in October as you entered uk within 90 days of your entry clearance.

You can apply for your ILR any time after 3 Oct 2012. This is when your 28 days period starts.
