Hello all. would like your advice/experience about my wife's case
I have been recently naturalised and I have been married to my wife for 11 years. My wife was given her spousal visa on my ILR in 2010. We are thinking of applying for her ILR using Set (M) in Aug/sept 2012. However, she had to spend a long period of time outside the UK (over 500days in last two years) to take care of her father who is seriously ill since March 2010.

My question is
1. Is there any time period /residency period for application using Set (M)?
2. what documents does she need to apply? does she need to be in the UK for this application?

look forward to your advice (s)

best
SKR

There is no specific number of days relevant to a SET(M) application, but it does need to be shown that the applicant is living with their spouse. "Over 500 days" outside the UK might cause a problem, even with a reasonable excuse.

In any case, the application would need to be made in the UK. It might be safer to apply for a further 2-year spouse visa, using form FLR(M). Even that would need to be applied for in the UK.

Has she already passed the Life in the UK Citizenship test?

1. Time spent outside the UK.
2. Must apply for SET(M) from within the UK.

She has passed her Life in UK test last Sept.
