ILR (JR) criteria in my case, is it applicable

I was on student visa in year 2006 and applied for HSMP in October 2006 before changes came into effect in November 2006. I got my approval and received the letter in December 2006. Back then I scored 65 points which was required. THen i applied for FLR (HSMP) and got refused in UK and so i had to travel to India and got my HSMP entry clearance on 16/03/2007.
I came to UK on 24th March 2007 on HSMP.
I have got my HSMP extended as Tier 1 on 16 March 2009 for further 3 years. It was extended under JR policy
Ques 1: Does my case come under ILR (JR) ?
Ques 2: Can i apply for ILR 28 days before 24 march or 28 days before 16 march?

Hi,
Answer to your first question. What I have seen is that generally, application date is considered as the date of Visa, not the date of Visa Granted. So IMHO, you should be covered under JR, being before Nov. 2006.
Reg. Second Question: Generally one can apply 28 days before 5th Anniversary. WHen you went out of UK to apply for FLR, was your leave still valid, or there was a break in your visa in UK?

my student visa was expired on 31st jan 2007 but i didnt go to india as my passport was with home office and they returned it to me on 10th march and i returned to India on 12th march ( 2 days after i got my passport) and got entry clearance on 16th march for HSMP.
So,although I entered to UK on 24th March on HSMP on basis of entry clearance on 16th March, I want to know that it is okay for me to apply under ILR (JR) policy and that if i could apply for ILR 28 days before 16th March or 28 days before 24th march?
