I am going to apply for my ILR under HSMP and Tier 1 category on 20th Jan 2012 in Cardiff PEO.

I have an issue I hope this forum could help.

I have the following questions.

[b]1. Do I need any Co-habitation documents? Is this applicable only for couples?
2. I never rented a whole flat or house on my own and always shared rooms. Do I need to get any receipt/agreement of tenancy from the landlord/lady to prove I have been paying rent?(Previously I shared rooms with my friends.)
3. I am moving house just one week before my Application (14th Jan). Does this will have any impact of my application assessment?[/b]

I have these documents for my application. If I need anything else do let me know.

1. SET O Application form
2. Life in the UK certificate
3. 4 Year P60
4. 12 month Bank statements (till Jan 15 2012)
5. 12. Month Pay slip print outs
6. Letter from HR about my pay and Job specification (I will get this just before my application)
7. Master’s Degree Certificate
8. List of absences (140 days)
9. Approval letter for HSMP and Tier 1 (Is this mandatory?)

It’s nice to have the Approval letter for HSMP and Tier 1 handy with you at the time of ILR. I have seen in posts that case workers often ask for at least the Tier-1 extension letter (which gives you the summary of points you were awarded).

So I would suggest taking at least the Tier-1 Extension letter.

How imporntant is that to submit the p60? I have only 4 years of P60. would that be enough?

You need to have P60s for all five years. If you are missing any of them, you can get your employment history from HMRC (I have seen a lot of people doing it on this forum and HO seems to be accepting it as a substitute of P60).

I am not exactly sure that what it is called as I have never done it myself but I have heard that it could take up to a month so you need to leave to leave a lot of margin before applying for ILR.

Just realised that if you are talking about the P60 for the current year, then you don’t need to worry about it and you don’t need to get anything from HMRC as the financial year has not ended yet.

The case workers know this and all you need is your pay slips to cover for last 10 to 12 months.

Thanks Linkers. The reason I am asking is when I got my HSMP I was not in a proper Job and doing two jobs. So wondering getting a employement history for that period will affect my application?
I got my HSMP on Feb 6 2007 and got a proper job from June 2007 and working for the same employer till now.

I don’t see any issue with that. I know people who have been doing odd jobs at the time of first hsmp and also at the time of extension and ILR, so you will be fine.

Do you have payslips and bank statements for the time you are missing the P60 for ?

No I dont have the pay slips. But I going to request my bank for my statements. As I have only last 2 yrs of statement with me. But all the payslips from my proper job.
I also just now requested for my employment letter from HMRC for the 2006-2007 missing p60

That’s great. I think you did the right thing. The best substitute for a missing P60 is the employment letter from HMRC.

Would you get the employment letter from HMRC before your appointment (which is 20th Jan) ?

Also did you book PEO appointment over the phone or via the UKBA site ?

I hope I will receive the letter before my appointment.If not dont know

Thanks for your prompt reply. I was only asking as I am myself on HSMP+Tier-1 and will be applying for ILR in May this year. So thought to check with you about the best way to book the appointment.

Hopefully you will get your employment letter before 20th but even in worse case, I don’t think so this can cause a massive problem, as the UKBA is more interested to see 5 years P60s for work permit or Tier-2 applicants who are applying for ILR. But as you are currently on Tier-1, I think you won’t have to face any issues for not having P60 for just one year. But it would be nice to take your all P60s and the employment letter from HMRC with you.

Also for Tier-1 applicants, they are more interested in last 12 months pay slips and bank statements (which is a mandatory requirement).

Please help with my query. If I dont get my HMRC letter before my appointment what should I do? as i only have 4 P60's and I see in the forums all applicants have 5 p60 or employment letter.

Shall I just extend my Tier 1 and apply after I get 5th P60 in May and apply my ILR in June 12?

P60 is not a mandatory document in your case.

If you have payslips for that period that shows your NI number, NI and Tax deduction that will work.

In addition to this, four year tax documents should be enough to establish the fact about your working. By the way, which tax year P60 is missing? is it before your first extension? or one after that.

If it is before first extension, than no problem as you have already proved your income at that time.

I got my hsmp on feb 2007 the missing p60 I am talking is the 2006-2007. If I don't need that year I don't have the pays slips or bank statements from feb - may 2007 but have all the p60 and pay slips from June 2007. So I got my proper job only in June 2007 so what should I do now?

You are worrying too much...

The documents you already had are enough to establish the fact that you justify the previous income criteria. In addition to this, you should be concentrating more on the current previous income requirement.

If you feel that your confidence is still shakey, then call HMRC and ask for the employment history, as stated by one of the member in an earlier post.

Other than the missing Docs (p60,payslip and bank statement) for the period (Feb 2007 - May 2007) my documents are perfect.
No over absence. As I have already applied Tier 1 my pay has gone up now so no worries with the earnings point either.

I know I am worrying too much as everybody has given 5 yr P60.
