ILR - With Unmarried Partner Question.

Hi Could someone help with my query/situation:

My partner and I both arrived in the Uk on the same date (12/03/2008) but on diff. Visa's

My Visa - Ancestral
Partner - Two Year Work & Travel Visa. (07/03/2008-07/03/2010)

After our first two years my partners had to return home and apply for a Unmarried Partner Visa to join me in the UK, which she got on 29/03/10, and valid till end of my Visa:08/0213. We have been living in the UK ever Since.

So in Feb 2013, I get to apply for my ILR & my question is can I apply for my Partner as a Dependant? (Her Visa at presant states: Visa To Join Partner).

Also do the 180 Days rule in 5yr apply to her (She will be over as she had to return to get on my Visa for just over a month)?

This is a tough one. I'm hoping a senior member can chime in here, as I'm not entirely whats appropriate.

As far as I know, you need to prove that you and your partner have been cohabiting for 2 years to be able to be included on your ILR application. How long can you prove you and your partner have been living together? Your partner will be 2 months short on the unmarried partner visa, but you may have a case (?) is you can show you were cohabiting for a while before. It might be worthwhile speaking to a lawyer or a firm handling applications about this.

Otherwise, ILR for you, FLR for your partner, followed by ILR for your partner later on (ouch in terms of £££).
