Please help - 2 days off completing 5 yrs for ILR

To brief you in on the details of my case. I was working in Uk since 2004 Nov as a doctor with Permit Free Training. In March 2007 I applied for HSMP and was granted the letter. My visa got stamped on 17th April 2007 for 2 years of HSMP till 17 April 2009.

In 2009 I sent my visa along with my spouses for renewal. As HSMP had been stopped, we were told to apply for Tier 1 visa. When I got my visa back they were stamped for 18th March 2009 - till 18th March 2012.

Now since me and my family are going to apply for ILR, I have been informed that technically I am falling short by 2 days even if I apply on the last day of 18th March 2012.
However my problem is that the renewal visa was stamped for 1 month earlier than when my visa was expiring and now they are giving me 2 options:

1) Either to write to case worker to see if it was her mistake in which case it would be fine. however there was no guaranty of time or if it will happen.
2) Apply for an extension of visa paying full amounts only for 2 days and then apply for ILR .

My Permit free training stay is not classed as being counted as far as I can make out.

Please can someone give me advise on what to do. It seems to be an expensive mistake on their part for which I would have to fork out full pay!. is there a way out.
