Clarification on the earliest date to apply for ILR

Hi,
HSMP 2Years + 3 Years Tier1

I called Home office helpline to know the earliest date I could apply for ILR.
I got HSMP stamped on 4th March 2007 and came to UK on 5th May 2007. 2 months delay.
I extended to Tier1 in March 2007 and they gave Tier 1 till 5th May 2012.

They said the Modernised guidance which ignores the 3 month delay in coming to UK is only for initial visa given for continuous 5 year period and the latest I could apply for ILR is only April 7, 2012 as my visa was given 2 years HSMP+ 3 years Tier1.

Any one in the same situation, who got ILR ( HSMP+ Tier1) based on the HSMP stamp date pls? can you pls share your outcome.

mailppk,

Did you get your tier 1 extension for 3 yrs 2 months instead of just 3 years.

Yes...2 years + 3.2 Years
