ILR For Company Director/Ltd Co. in Feb/March 2012

Hi,

I'm currently due to apply for my ILR in either end of feb or early march and just wanted to confirm the following points? Application based on Tier 1 General.

Applied and got HSMP (21 March 2007). Entry clearance to UK heathrow airport was 31st March 2007 (10 days from start of HSMP approval).

Questions are?

1. When does the 28days starts for me to apply early? is the 21st March when HSMP was issued on the passport or 31st March when entry clearance was stamped entering UK?

2. I'm using a solicitor and has advised I get the application (same day service) in before the 29th of Feb as the new Biometric process will come into place, which means I will have to book a separate appointment for Biometric registration and also another appointment for ILR which we are trying to avoid and hopefully apply either 26-28 Feb 2012.

3. MY accountant will be making the necessary letters, voucher credits and other Tax/NI/HRMC calculation available as I'm being paid Salary + Dividend and I'm the only Director on the Ltd Company.....What are the docs needed?

- Ltd Co Bank Statement?
- Personal Bank Statement?
- Letter from Accountant?
- Any Letter from HRMC including a Tax overpaid refund I got from HRMC just before Xmas last year?
- All Ltd. Co Incorporation, VAT registration?

4. In regards to the Age Point, I was 29 in 2007 when I applied and now will 33, well gonna be 34 in 10th March. Will i still be able to claim for the Points I claimed in 2007 or no points will be awarded now since i'm no longer 29?

5. My current salary + dividends is just under 40k, which I used in my HSMP application back in 2007....Will this be a problem now or will have to evidence it to 40k?

i am submitting the following for ILR next week

1. 4 quarterly payslips on my company letter head
2. personal and company bank statements
3. dividend vouchers on company letter head
4. letter from accountant confirming that i am sole director , gross profit, net profit, tax, dividends taken and dates, salary and dates
5. getting invoices on company letter head , stamped and sealed
5.1 Company incorporation certificate
5.2 in the letter from accountant mentioning that my corporation tax is due only in may 2012 so I have'nt done it
6. Life in the UK test
7. Masters certificate as i got it aftermy extension
8. passport
9. absense spreadsheet
10. 5 years employment history letter from hmrc
11. VAT registration documents and VAT returns

Hi,

Thanks for the information. In regards to your salary, believe you are getting paid combination of salary + dividends, right? And those this total over 40k threshold (Class 1 NIC) or up to the same amount you claimed for in 2007 when you initially for HSMP approval?

Secondly, how do I get the 5yrs employment record/history from HRMC? I've got all my P60 for the last 5yrs except for 2011/2012 which wont be available after end of the current tax year? Also in regards to Corporation Tax, mine too will not be available much later in the year as advised by my accountant. Also thinking of getting a letter from Companies House showing that I'm a Director on my Ltd co. but guess you are covered from the letter from your accountant already stating this.

Hi there, please note that for a Limited company you need accounts from Chartered Accountant. BS showing salary being paid to the account and also showing the dividends being payed into your account along with the dividend vouchers.

What do you mean my "please note that for a Limited company you need accounts from Chartered Accountant"?

I've got all other all other docs you mentioned

Hi, Basically what I meant was that you need to show two separate evidences. One evidence would be your company papers etc along with your accounts showing that your company has done enough business to generate the amount you are claiming for. The other evidence what they ask are the dividend vouchers (incase of a limited company) and the amount shown on the dividend vouchers being transferred to the account. For example you claim that the dividend vouchers say that you x amount to be taken in lieu of dividend vouchers. Then what the HO will ask is your company bank statement that you have transferred the amount specified in your dividend voucher to be transferred to your account. Basically in case of a limited company, the company is a separate structure from yourself. Your company account show that you have done £45000 business last year. You can not claim the £45000 earning points unless you show that this money is in your account to be able to justify the points claimed. You can not say to the HO that by virtue of doing £45000 business (which is company earning) you can claim points. I hope I am clear on this but if not then let me know and I will explain further. The guidance notes explain this but in a confusing way.

Sorry about the Chartered Accountant bit. Basically your company accounts should be from an established Certified Chartered Accountants or Certified accountants which can be verified independently.

Hi,

As a Limited company director i submitted following documents:

- 12 months Personal bank Statement

- Dividend Vouchers from last 4 years. That's when i started working as an IT contractor with my own limited company. Dividend vouchers were on companies letter head / stamped . Also counter signed by the accountant.

- Business bank statements of last 12 months

- My companies contract copy with the customer (in my case it's a reputed company where i do the contract work) which clearly mentioned my daily rate , length of contract. Case worker was happy to see these contracts.

- My last 3 years company tax returns / accounts - this was crucial. She did ask for it & gone through in good detail.

- VAT Returns to HMRC for last 4 Quarters

- Last 12 months Invoices & the remittance advices ( though she didn't ask them) - but good to carry

- Accountsnts letter confirming my salary , dividends & share holding. ( i take a minimum salary which is under tax threshold , so had to submit pay slips & P60 for last 3 years)

- Other general stuff like Degree cert / age proof / marriage cert / cohabitation proof / absences sheet / Life in UK test cert etc

I am also a director in my private limited company. I shall be grateful if you can answer few of my following questions regarding Tier 1 extension application.
1. I am also IT consultant. In last one year I have done two contracts with other companies and still doing second one. I have contract copies, I will attach with the application as you did. I did the same when I was using an umbrella company 3 years ago for initial Tier 1 application. Do I need to do this again as director of my own limited company?

2. Dividend voucher is required to be on companys' letterhead?

3. Did u not supply salary slips. If you are not taking salary then it is under self-employed category I think?

4. Why did you attach VAT returns?
