My ILR is due in July 2012, The court has ordered on 18th Jan 2012 that my driving licence be endorsed with 3 points and £60 fine (Using mobile phone while driving).

Another court order was made on 8th Sept 2009 stated that my driving licence be endorsed with 6 points and £400 fine.(Speeding).

My Question is that above two court orders would have any impact on my ILR application or shall i go for tier 1 extension.

check yr CRB

if it is cleared , u got to inform in ilr form and u will be ok

if CRB negative than u r in red go for extn

any way for safer side go for first extn than ilr

I had my CRB checked, its came out with clear no convictions, but homeoffice does not only rely on CRB, they must have other sources to check wether the applicant has any criminal convictions.

If i get refused for my ILR application due to my two court convictions , will i be able to apply for tier 1 extension. Do i have that right at that time to further extend my visa

Cheers

Why did you allow it to get to court. You should have paid the fine without getting to court.

Howbeit, what I know is that FPN are not convictions if not giving in court. Hence will be overlooked in you font have two within a year.

Since yours got to court I cant guaranty it will be overlooked.

Yes, you will be granted FLR if ILR inst successful though I don't know if you will have to reapply for that separately (losing the fee for ILR).

You best bet is to try ILR....first......

I would agree with diehardall1. If you get court involved, (by arguing and delaying your application) you end up paying more fine, more points and your conviction becomes a criminal conviction.

People on PBS should avoid going to court and pay the fine immediately without asking any question.

a points on a license and a fine. you will be fine.

convicted of speeding, the fine comes from a court so it doesn't necessarily mean that subject has been to the court. that is the normal procedure. also, sometimes, a speeding case is way out to be dealt with fixed penalty which means it has to go to court to be heard and points given. still doesn't mean that it will appear in CRB

Let me clear it for you. Criminal Convictions such as traffic endorcement are not covered in CRB. you need to go to Any Police station and apply for your criminal record report via Data Protection Act . they will charge you £10 and you will receive it in Post.

you will be fine. I take you have 3 points and £60 for SP50 and CU80. I wouldn't worry about it.

I got my ILR last month July 2012, while I had unspent traffic conviction. 5 points issued by court with £300 fine. Case worker looked at the conviction page, but didn't pay any attention to it even though I have entered all my details.
So don't worry and apply in confidence.

My situation is almost same, there is no record in CRB . offence code is IN10 . £400 fine and no points.

So can I apply for ILR and should i mention in SET(O) form ..

Hi, I am in a similar situation - I have got CU80 with 3 points and 60 points. Paid the fine by credit card over the phone within the required time and sent my licence conterpart by post for endorsement within the required time of 1 week. did not have to go to court. People who have got their ILR in similar situation please advice. I would be applying after 13th December when the new rules are in place.

don't know about him but I had 2 x Traffic FPNs for speeding and I successfully got ILR, just to put your minds on rest.
