Can my Son remain on tier 1 if I change to PR status

Hi,


I have gone through the set of details provided on this forum and I liked it alot as the cases/guidance provided are quite informative.

presently I am on tier1 status expiring in Sep 2013 and my wife/son both are on tier-1 dependent status.

In April 2012 we are getting elligible for the PR and I will be applying for the PR for me and for my wife, But I do want to apply for the PR for my son as he is born in UK and wanted to apply for the british citizenship for him.

I have following queries:

1) I wanted to apply for citizenship for me and for my son next year together. can we do that?

Does the status change on my end will impact him by any means i.e. his tier-1 dependent become void or he can be on that Tier-1 status until next year (being us on PR status) and there will be no issue while travelling out of the country. (as i m have to go out of the country for vacation).Please suggest as I am getting too confused here.


2) if his tier dependent become void due to my status, i feel i can apply for his British citizensip after my ILR done...is it correct? please confirm

If not travelling, then no, leave to remain application is not required, as there's sufficient leave left.

However, Register son straight for British citizenship after you get ILR and subsequently apply for a British passport, before any travelling. Dependant visa will not be appropriate for entering the UK.
