Hi,

Can anyone confirm of the WP dependant MUST to apply for ILR with the main applicant. My friend is on a WP and will be applying for ILR next week, but his wife wants to go to India for a month or so. Both have 2 years still left (WP & WP dependant). Not sure if it will create an issue when coming back to the UK or will be the WP dependant visa will be valid if my friend gets an ILR..

If his wife leaves UK without applying for ILR, and your friend gets his own ILR in her absence, his wife’s WP will be curtailed.

Therefore, she should travel to India after grant of her ILR.
