EEA2 ROR Home Office supporting letter

Hi everyone

Could anyone with retained right of residence tell me what is written in their Home Office letter? I have received 5 years RC card based on retention of rights however the letter which came with it does not mention anything about retention. Instead, there is just a standard wording for a family member of EU saying i have to notify if get divorced or my wife leave the country. But i received ROR because i divorced. So it doesnt make sense.

Is a normal practice or their mistake? Any help would be appreciated.

I think is a mistake you need to wright a letter
To your case worker I get the same letter last
Month when I get my ror but many people on forum tell
Me to wright a letter to my case worker and he will
Send right covering letter but am about to send my
Letter too and their is a guy on forum
That say he get the same letter and he wright is case worker and re issued right
Pls am just using this site can you help me about my brother wife
She just doin 15hours a week

If this is the case then it sounds like a standard practice, simply cant be bothered to do a different letter.

This is a (common) mistake. Contact the HO and ask for a correct one. Will make your life simpler as it would the only proof you have you have retained your rights (as the RC vignette is the same).

A few months ago I retained rights of residence using a very good lawyer. I received the same wording letter. I was told everyone gets such letter from HO. I even phoned HO to check about it. The main thing all the detail of it are on their system anyway. I travelled a month ago and didn't have any problem and no questions asked at the boarder.

Regulation 17(6A) as amended require the SOS to issue a card entitle family membet who retained their right of residence. If UKBA issues a document which is at variance with that provision, it cannot be said, with confidence that UKBA acted in accordance with the law or issued the documents requested.

In my view, i believe it should be queried.

If someone writes you a letter saying i am giving you a document as family member of an EEA national when you are not, you have to query this, as this is not what you applied for. Parliament has made it clear what you should be issued with and how the document should be called. It is unlawful for them to issue something else, that does not reflect that which you have applied for.

If it went to court, they could say it was Residence Card as a family member that you applied for, and they could simply revoke it, if in future you come to their adverse attention.

If however you inform them of this, and at most get a letter stating you got the right thing, you can keep that for future purpose. Even if they don't change it, it will not be said that you never queried the accuracy of the letter and endorsement you received.
