EU Family Permit via Surinder Singh and Self employment?

Has anyone received a family permit through self employment without registering as self employed in the EU country? We are in Germany and the tax office has lost our application from a month ago and we were going to get my husbands clients to do receipts for work again with this tax no after we got it, and his invoices say hes applied for it to clients.

He has been paid by the companies but without this registration he's not 'officially' self employed/economically active in another EU country is that correct and UKBA wouldn't accept it?

He could get letters from clients to say he worked for them in the last few months+ these invoices/receipts but very worried as we wanted to go back to the UK for Christmas and might have to reapply and he has work in London soon
