EEA national applying for a PR being on maternity

Post by Elena8 » Sun Mar 16, 2014 2:21 am

Hello everyone,
I am EEA national and had been exercising treaty rights for a more than 5 year (2008-2014). Does it mean I automatically have permanent residence and don’t need to obtain PR certificate?
Currently I am on maternity leave but have to make a decision whether to come back to work next month or not.
The question is following: My husband is not EEA member, but has an EEA family member residence card. Will I be able to stay legally in the UK and my Husband can continue to work for the UK company being my sponsor if I decide to stay at home and take care of our child?
Or I have to continue exercising treaty rights to be a “Self-sufficient”?
(i.e. continue my work contract or cancel a contract and buy some comprehensive sickness insurance)
Also I would like to apply for a British passport, should I provide evidence of Self-sufficiency for a period of 6 years or it is enough to prove I have PR status?
Am l still qualified as a "self-sufficient" if I don't work but have comprehensive medical insurance and get child benefits?
Spent hours looking the answers but could not find full information.
Thank you in advance for help.

In what capacity have you been exercising treaty rights? if it has been exactly 6 years since that you have been exercising treaty rights, you may well apply straight for British citizenship, If you have PR you do not have to worry about meeting the requirements under the regulation anymore, your family members will also be covered on your PR status.

Thank you dalebutt for the prompt reply.

The only thing I would like to clarify is following:
I still have to apply for PR certificate and going to do so very soon, but I have to make a decision this month whether I stay with my child or come back to work. Also, according to the law my non EEA partner allowed to stay and work in the UK while I excise treaty rights only.
The question is following: If I don’t come back to work and cancel my contract should I buy comprehensive health insurance to be a “Self-sufficient” before I applying for a PR or I don’t need to excise treaty rights anymore as I already had been doing this during 5 years ?

And last thing I would be really keen to know: Am I eligible to apply for a PR if I get child benefits? I started to receive child benefits before I completed 5 years of exercising treaty rights. Will child benefits affect my PR status if I stop working in the UK?

Thank you.
