Hi Masters. I married my EEA wife in her country in 2008. We have been having a lot of problems after my kids joined us here. She left me without divorce last year after threatening several times after each altercation that her passport would be
useless to renew my stay but often going back to say it would be ok. Submitted her self-employment national contributions, self-assessment docs and a letter she got from her accountant stating she was self-employed which she agreed at the time would be sent to ukba. Also sent her passport which she left behind. To my surprise they refused mine and the kids application as she had declared her passport lost or stolen and a valid EEA passport is required under regulation 17(1)(b) of the 2006 Regulations. Is this really correct after the decision in SSHD v Barnett?
I found in her pile some business cards, a book with names and amount she received from clients for doing her cleaning work as well as a few receipts. Can I submit this with the bundle and go for oral hearing?
Please what are our prospects?
