I am non EU, I came to uk first in 2004 and was coming for 3 summers for seasonal work. During summer 2005 I met my future husband who is Latvian Citizen. In March 2007 we got married. In April 2007 we came to UK to live here. I first had a EEA spouse visa for 6 months, then the same for a year, then family member of EEA residence card for 5 years. Our son was born in April 2009. In March 2012 my husband trough knife at me while drunk ( he has had drinking problems) and I called the police so we got separated, he has been on a bail not for long but we didn't get back together as I couldn't live like that anymore. We got divorced in April 2014 on a grounds of unacceptable behaviour. I have full custody of our child who is Latvian Citizen and away to start school in August 2014. I have applauded for EEA4 but received refusal last nite because I didn't provide evidence of my ex husband excersing treaty rights. In September 2013 my ex husband has been admitted to the mental hospital as he has been taking legal highs. just now my ex husband is on bail condition too since September 2013 for breaching peace.I was looking at other residence card called derivative rights card as a carer of a child in full time education, but again I have to provide evidence of my ex husband treaty rights. I have a good job and earn money to provide for me and my son, my ex husband doesn't help us financially. One thing I cannot get is how I can provide his documents if we aren't together, if we aren't married.... They asked for me to send his passport and his residence card,and proof of his treaty rights.
Have anybody has been in similar situation? What other visa I can apply for? Any help would be greatly appreciated. Thank you, Tatiana
