How can I delay the Decree of NcSi?

I have returned my answer to the court.I don't defend the divorce but I said I contest the false accusations of domestic violence.

Does anyone know how long does the court take after receiving my answer to the divorce petition?

How do I fight against this false claims of abuse if there's no evidence? Isn't it his word against mine?

This year in November 5 the we would be three years but I'm hoping it will drag and take time so I can I apply for ROR?

Do I need evidence from him to apply for ROR? The only three documents I got is two banks statements of his dating 2013 October, a few copies of his wage slip, copy of his passport and a letter that we used in 2011 to apply for my Resident permit card. It's a letter from the hospital where he worked? Is this enough documents or will I be able to use them? My ex partner will not co operate.

He is black mailing me to accept the false accusations and to hand over £410 for the divorce before he consider providing his documents!

I pray a God is with me in this difficult time!

How long does it take for the first stage of the divorce to be complete?

My solictor has given me wrong advice and he made me to instruct him to send of the answer of the dissolution to the court. He said although I have put on the documents that I dont agree to the grounds of the divorce it dont mean i contest the divorce.

The dissolution is filed to the court before the three year period. This november it would have been three years of the civil partnership.

My only hope is now to send of an application for ILR because I do qualify for it. But the solictors advised me that I need to show documents that my ex partner is stil excersing his treaty rights in the UK? How can i proof that, if the only documents I have of him is two bank statements from 2013, copy of his wage slips( not original), his european medical card that I found among my documents, a original letter from his employer that we used in 2012 when we applied for my resident permit card, a original letter for his nursing registration. Thats the only documents I have with his name on. I got four years of jojnt bank account statements with both our names on. A tentancy agreement with our names on, a few bils with our names on for the 19 months we lived together. Holiday arrangements and pics together for the 19 months.

As the divorce is stil pending, or I dont know what is happening, is it a good thing I just apply now for my ILR based on the ten years i have been here or do I wait and see what is happening with the divorce.

If the final divorce document come through now I have to leave as i dont have any rights in the UK. But if i apply for my ILR i stil have the right to stay until i get an answer from the home office.

Thank you for commenting askme83, but the civil partnership divorce is filed to the court before the three year period. This year in november we would have been 3 years but out of spite my partner went ahead in july this year and filled for the divorce just because he black mailed me to hand over money to him of which I did not want to do. He wanted me to give him money so that he can file for a divorce because I AGREE TO PAY HALF OF THE MONEY but he wanted me to pay the full £ 410.

Nasty people on this earth..

The divorce is still pending at the court.. So as its filled before the three year period I got no chance to apply for ROR.

aND FOR ME TO APPLY FOR ILR i need proof he is still excersing his treaty rights and i dont have any documents other than the ones I mentioned in the previous post
