EEA national PR application-Job Seeker OR NOT?

Post by AMIAMI10 » Mon Nov 17, 2014 12:32 am

EEA national, Bulgarian citizen (thus restrictions until 2014), Accession Worker Cards etc.
Have some gaps in employment in my first year in the UK, one for 1 month and one for 2 months and 7 days.
On which basis should I apply during those gaps? Retaining Worker Status or Job Seeker? I was made redundant, I DID NOT choose to leave my job.
Do these gaps disqualify me - is this a 'breach of continuously exercising Treaty Rights i any way'?
At that time I WAS NOT ALLOWED to register formally as a Job Seeker:
1. I first had to apply for permission to work from UKBA (Accession worker Card) and for this I need to have a firm job offer; obviously with a job offer what was the point of asking for JSA?
2. I was told by Job Center Plus at the time that I needed to have had at least 12 months of employment and NI payed before I could apply for JSA, thus NOT eligible.

My questions are:
I cannot make sense of what the law says.
1. DO I need to have been formally registered as a Job Seeker to have the 'Job Seeker ' status? If yes,how was I supposed to do it if the law didn't allow it?! Or is this only to retain Worker status?
2. I read about a case where the applicant had less than 6 months of job seeking in total and the Judge granted him PR. Does it have to be less than 6 months in total, or less than 6 at any period of time?
3. I was actively looking for jobs during those times of unemployment (both involuntary) and I have at least a job application e-mail for EACH DAY for those gaps. IS that enough to prove that I was looking for work? Is this enough to make me a Job Seeker?
4. If they don't classify me as a Job Seeker then they will say I was self-sufficient and that is NOT OK-I did not have Private Health Insurance at the time nor did I know that I needed one for those periods of time.

If you have INFORMED answers please reply and if you could also explain in which quality you are providing those answers, thank you. If you are NOT sure of how the law is interpreted, please refrain from posting .I've already had a horrible experience with an Immigration Solicitor who did not answer any of my questions. I think they function like those automatic fortune tellers: you punt the coin in and pearls start coming out of their mouth!!! Makes me sick!

Best of luck to everyone else, grateful for your help!
