Confusing EEA2 situation with possible divorce.

Hi all,

I know the question about divorce and EEA2 has been asked but I have a slightly different variation and would like some advise.

I came to the UK on a Tier 2 visa in 2009, with my German partner (non married at the time). We'd been dating and living together for 3 years and hence then applied for an EEA2 visa while I was here which I receieved a year later in 2010.

In 2012 we go married and the entire time whilst in the UK we've been living together.

Sadly, lately things have been going badly and although we've been doing quite a lot of counselling I think it's going to fall apart :(

At the current point in time, I've lived a total of 4.5 years in the UK (oh I'm the Australian non EU resident) of which 1 year was the Tier 2 (guessing this time doesn't count). So I've been on my EEA2 for 3.5 yrs of which 2.5 yrs we've been married. I got the EEA2 visa based on civil partnership and we'd been living together for over 2 yrs (btw it's not a gay relationship not that it matters but I've noticed people talking about civil meaning gay partnerships).

Anyway, I'd really like to know where I stand? I run a company here but assume that doesn't mean anything.

I haven't been married for 3 yrs (only 4 months to go) but I have been in my partnership which the EEA2 was granted upon (currently the home office doesn't know I'm married as I got married in Germany).

Any ideas?
