Should I appeal or wait and apply again EEA3

Post by Saladin0011 » Mon Jan 12, 2015 9:05 am

Hi good people.

Today I received back my application pack but I was refused
Reason was that I didn't work continuously 12 months under WRS. I had 4 employment under WRS which i showed and proved in my pack but case worker probably didn't see one of them and he "said" that I have 8 months gap between jobs + one job I started 14.1 and finished 07.02 so I don't think i had to apply for WRS at the moment.
Question is if I should appeal or just wait 3 months and apply again (because that will be another 5 years from starting living and working in UK) and maybe not showing that I was visiting and working in UK between 14.1 and 7.2 because in that time I was as well studying in my country.

I want ask. If person from A8 country came to UK in 2004 and until 2011 every time worked for each employer 8-10 months (every time registered in WRS), is he/she eligible for residency or not? Does this person need to wait until 2016 to apply for residency?

are you saying you have wrs certificates covering 12 months since you started working and they refused your application?remember every time you changed job during first 12 months you had to do wrs again, if you have`t done it now its too late to put it right.
if thats the case I would send complain to them and ask them to put thinks right free of charge.

No, what I am saying is that since 2009 until 2011 every time i worked i applied for WRS (except once when I worked only 3 weeks for company) but usually stayed for 3-7 months in the same work.
According the law i can be out of UK for almost 6 months every year but according this letter I can't apply for PR because I never worked full 12 months under WRS in one company.
Funny enough after they abolished WRS in 2011 I am now working for same company over 2 years and it is not enough.

Is it right?
Is it really so necessary to work form 2004 till 2011 for one company under WRS 12 months or could I change job every 6 months but still every time registering with WRS and now getting PR?

you was`t required to work for the same company for 12 months, you was required to register again to you complete 12 months. seems like they overlooked your paperwork.

I called UKBA/HO and that dude told me that I can't apply because I didn't work 12 month for one employer>
Another reason was that I didn't register under WRS when I once worked from 14.01 until 07.02. I though that is not necessary but probably it is.
Now I am thinking to apply in few months again but not mention this 3 weeks job.
What do you think?
