Hi everyone! I have a few questions about marrying a British citizen. I'm from Hong Kong holding a British National Overseas Passport. I have been with my boyfriend who's from Manchester for more than 2 years. We have been in long distance relationship, and then we were together for a year in HK. For some reasons, he has gone back to England. We feel really frustrated about being apart because he can't meet the financial requirement for getting the spouse visa. I wonder if we can use the Surinder Singh Route? If yes, what should we do? Since UK is also in EU, does that mean we can get married anywhere in Europe and then I can go back to UK with him and apply to stay? Can you please give me some advice on this? One more thing is if I apply Youth Mobility Scheme, can I get married in UK with my boyfriend? Or Is it better to get married in other EU countries then wait for him to get a job outside UK?

You having an Overseas british citizen passport is not going to help you in any way with your application . I have one , its useless.

Inorder to qualify for surinder singh route , you and your boyfriend has to move to another european country , and establish a life there . (Live there for 4 months , get utility bills and every other document possible )

Also get married wherever you want to live for 4 months inorder for SS route while you are at it . :)

The Surinder Singh route has become tougher and you are likely to need far more than 4 months residence. Your partner will be expected to show that he has 'transferred the centre of his life' to the EU state which will include employment, registration documents, leasing accommodation etc. You can apply for a Youth Mobility Tier-5 visa if you qualify and will be able to marry while you are in the UK. However, in order to switch to a spouse visa you will still need to comply with the financial minimum income rule.
