Returning to UK after more than 2 years absence

Post by frency » Mon Sep 07, 2015 1:20 pm

Dear members,

I have received an EEA residence card for 5 years back in 2013, however I have been absent for over two years from the UK due to family matters.

My partner is still in the UK but our relationship has broken down and we are thinking of starting divorce proceedings.

I was thinking of travelling to the UK at the end of Septmber.

Is my residence card still valid and will I be asked questions about this by UKBA at the airport entry?

Thanks for all information.

Frency

RC is not a visa so if your circumstances change it can become invalid even if it's still 'unexpired'.

Your status in UK (especially if a non-EEA national) probably now depends on how long you've been married & if there is a divorce.

See http://www.passportia.org/blog/uk-immig ... ence-cards

Best of luck.

Thank you for your reply noajthan.

I am more interested to know if I would be asked any questions at the moment of entry in the uk because after this there are other things to consider.

Best wishes!

Note PR expires after 2 years absence from UK; as PR represents settled status and RC only reflects your status at time of issue it suggests RC may well be invalidated after 2 years away too.

You really some of the Europe-hands who may have direct experience of attempting such an entry (after long absence) to comment.
