After EEA2 family permit, what's next?

Post by driftkid » Sun Dec 27, 2015 9:47 am

Hello Everyone, I am a British citizen, my wife and my 2 children have EEA2 family permit, and we are now more than 3 years living in UK. My wife also working at meantime. My question now is, Can they apply for the British citizenship already or they need to wait for 5 years before we can apply for their PR? I heard that children can apply for citizenship after 3 years, is that true?

As you are British by descent, you may be able to register you children under section 3 (3), if you have indeed spend 3 years in the UK since your return from Italy.

Wife will have to wait for a further 2 years, until she has acquired the right of Permanent Residence .

yes I am British citizen by descent, but my children were born abroad, but they don't have ILR yet,do they need the ILR for applying the citizenship? they are using EEA family permit, and we are living in UK for only more than 3 years, I believe we need to be resident for 5 years before the ILR.

The path of your wife to British citizen is quite different from your children.

Whiles your wife will require Permanent Residence, your children born overseas do not.

No you children cannot apply now for PR, as they will not qualify, but you can apply for them to be registered as a British citizen under section 3(3).

Your wife will definitely need pr to qualify for naturalisation, and the earliest time that this could be done is 2017.

But the children don't need PR to qualify for registration as a British, under the provision I cited.
