ROR or Long stay ILR?

hi all,

can someone please advise what is the right thing to do in this situation:

Marriage ended after 3 years and half but the no-EEA family member would be legally in the UK for 10 years next December.

Is it better to apply now for ROR or to wait for December and apply for ILR based on long stay?
