non-EEA partner of naturalised dual citizen - Lounes implications

Post by robbie296 » Sun Jan 20, 2019 11:05 pm

Am curious about the following

EU citizen with non-EEA spouse - both holding documented permanent residence with treaty rights being exercised since 2010

EU national naturalised as British citizen after having obtained permanent residence certificate for both

In principle no practical impact of Lounes changes to the EEA regulations (July 2018) on their situation - except that the EU national has had his permanent residence reinstated as a result whereas under the pre 2018 EEA regulations that was automatically deemed lost upon naturalisation (correct?)

Given that the EU national now holds both British citizenship and EEA permanent residence status, is it therefore technically possible for the non-EEA spouse to also obtain this dual status - ie continue as permanent resident as a family member of an EEA citizen, but at the same time become a naturalised British citizen?

Also I presume EU national will be able to apply for the new settled status on the basis of their pre-existing permanent residence status, notwithstanding their dual citizenship?

It seems like logically there is no reason why all that should not be possible, but I may be missing some nuances here

there are always reasons. My question was really whether that is the correct interpretation of the law post-Lounes?
