Hi, me and my girlfriend would like to get married but there’s some uncertainty and it would only be possible after Brexit. I am a Romanian national and she is Korean. We will marry after Brexit, but I don’t want to apply for -Pre-Settled status until we get married as I fear she won’t be considered as a EU Settlement spouse. We’re not able to get a Visa under the UK immigration scheme because I will be studying from April and working only part time, hence I won’t meet the income requirement. If we were to get married it would most likely happen before the cut off date for settled application which is December 2020. Would she still be considered a EU spouse if we marry after March 2019 by the end of December 2020 and would she be able to apply for Pre-Settled status as well? Might I add, she is living with me on a Tier 5 Youth Mobility visa that expires on December 2019, she has potential to get a work visa, but if the work visa does not work out, marriage is our only option. Thank you.
