Eu settlement scheme family permit & right to work

Hello,

I am an Spanish citizen living in the UK, who has been granted pre-settled status.
Recently, I married a Russian woman, which at the moment is applying for the "EU settlement scheme family permit". My main question is, does this permit grants the right to work in the UK?

I have checked https://www.gov.uk/legal-right-work-uk which does not mentions the EU settlement scheme at any moment, in any of the questions , both referring to me or her. I found in this forum another similar topic, but it talks about EEA family permit, which is not exactly the same. None of the information I found regarding this permit mentions anything related to work denial/authorization to work, and I am wondering if any of the folks present here had been under the same situation and can throw a bit of light.

If she has been issued with coa then employers can chexk online i email and got that reply for euss

We understand that having applied for status under the EU Settlement Scheme, you would like to know if you can use your Certificate of Application (COA) to prove your right to work in the United Kingdom whilst your application for status is outstanding.

 

We can confirm that for the purposes of the EU Settlement Scheme, a COA is issued to the applicant by the Home Office to confirm that they have submitted a valid application under the scheme. It does not confirm that you have immigration status in the UK.

 

This means that the COA you have been issued with under the scheme does not automatically convey a right to work. It puts the responsibility on the employer to conduct relevant checks with UK Visas & Immigration department to confirm the applicant has a right to work.

First of all, congrats!

I believe she shall be given the right to work - same as for EEA FP route. One of the reasons I decided to go through an old path myself was insufficiency of information and experience with new route. Good luck! I hope you will be reunited very soon

@mubashir1981: as far as I understand, you were a step ahead of us. We are still waiting for the Family Permit. Do we have to ask for something after? I think we only have to ask for Settlement Status like any other European.

@iwolga: so with the other family permit, which is supposed to be "exactly" the same, the holder has right to work straight away? Because the gov.uk webpage didn't talk about it either.

As per EU regulations, EEA FP (6 months) does give your wife the right to work. The problem that some of the potential employees are facing in UK is that this Entry Clearance visa (EEA FP) isn't included into British list of papers proving the right to work. Hence it's a bit of grey area. The right is there but it is possible you won't be able to prove it to potential employers.

Because of that (and to help with further travelling) people normally apply to EEA2 card or pre-settled status. Some employers are satisfied with a Certificate of Application (CoA) that HO sends you in the middle of this process. Some would want to wait for the BRC itself.
